1. Definitions

In these terms:

• FUNE means the digital platform, the website and the related services, offered by Fune B.V. (FUNE).
• User means anyone who visits the website, signs up for the newsletter or waiting list or, once possible, creates an account.
• Service means everything FUNE offers through the website and, in the future, the app.
• Account means the personal environment in which a user can record content. Accounts are not available yet.
• Content means all texts, files, recordings, images and other data that a user stores in their account.
• Newsletter means the emails with news, product updates and information from FUNE that you can sign up for via the waiting list.

2. Applicability

These terms apply to every visit to the website and every use of the Service, including during the current Coming Soon phase.

Deviations only apply if agreed in writing. The user's own terms do not apply.

3. FUNE services

FUNE is a digital platform that allows users to record information, wishes and memories for later, for example for their loved ones.

FUNE is currently under development. On the website you can sign up for the newsletter and the waiting list. Account functionality and other parts of the Service will follow; once available, these terms apply to them as well.

FUNE does not provide legal, notarial, financial or medical advice. What you record in FUNE is not a will or any other legally valid document, unless the law or a competent party determines otherwise. If in doubt, consult a professional.

4. Account and access

It is not currently possible to create an account. To the extent accounts become available later, the following applies.

You create an account using accurate and up-to-date details. You keep your login details secret and tell us immediately if you suspect someone else has gained access.

You are responsible for everything that happens through your account. FUNE may restrict or block access to an account in case of misuse, a security risk or a breach of these terms.

5. User responsibility

You use FUNE properly and with respect for others. You may not:

• use the Service for unlawful, misleading or harmful purposes;
• store or share content that infringes the rights of others, such as privacy or copyright;
• bypass, disrupt or overload the security or operation of FUNE;
• collect or process data of others without being entitled to do so.

6. Availability and development of the service

FUNE is under active development. The website and the Service are provided as they are and as available. Features may change, be temporarily unavailable or be discontinued.

We aim for a careful and reliable platform, but cannot guarantee uninterrupted availability or error-free operation. Maintenance and outages may make the Service temporarily unavailable.

7. Intellectual property

All rights in the website, the FUNE brand, the logo, the design, the texts and the software belong to FUNE or its licensors.

You receive a personal, non-exclusive and non-transferable right to use the Service for its intended purpose. Copying, distributing or commercially using parts of FUNE without prior written permission is not allowed.

8. Content stored by the user

Once accounts are available, the Content remains yours. FUNE only receives the right to store, process and display your Content as far as necessary to provide the Service to you, for example to share your Content with others at your request.

You are responsible for the Content you store and for deciding with whom you share it. Make your own copy of important Content where necessary. FUNE does not use your Content for advertising.

9. Privacy and personal data

FUNE handles personal data with care. How we do so and which data we process is described in our Privacy Statement.

10. External services

To operate FUNE we use external parties, for example for hosting and sending email. The terms of those parties may also apply to the use of their services.

Third-party websites or services that FUNE links to, such as social media, are not our responsibility. FUNE is not liable for their content or operation.

11. Limitation of liability

FUNE is only liable for direct damage that is the immediate result of an attributable failure. Liability for indirect damage, such as consequential damage, lost savings or loss of data, is excluded to the extent permitted by law.

Where liability cannot be excluded by law, it is limited to the amount you paid to FUNE in the twelve months before the event causing the damage. If you paid nothing, that amount is nil.

Nothing in these terms limits liability for intent or deliberate recklessness, or rights that a consumer can claim under mandatory law.

12. Changes to the service and terms

FUNE may change the Service and these terms. The current version is on the website, with the date of the last change at the top. For a significant change we will inform users with an account or newsletter subscribers in an appropriate way.

If you keep using the Service after a change, you agree to the changed terms. If you do not agree, you can stop using it.

13. Termination

You can unsubscribe from the newsletter at any time via the unsubscribe link in every email. Once accounts are available, you can cancel your account at any time.

FUNE may end or restrict access to the Service if you breach these terms or if the Service is changed or discontinued. Provisions that by their nature are meant to survive termination, such as those on intellectual property and liability, remain in force.

14. Governing law

These terms and the use of the Service are governed by Dutch law.

Disputes will be submitted to the competent court in the Netherlands. If you are a consumer, you keep the rights that mandatory law gives you, including with respect to the competent court.
